Can things be filed electronically in the CM/ECF system after 5pm local time on the day of a deadline?The Judge ordered a joint status report and the defendant's attorney dragged things to the last minute. I got stressed and went rogue and filed alone because the 5pm close of business day was approaching. The defendant's counsel filed alone too minutes after 5pm and the Judge granted his proposed order. So I'm confused. Do I have until 11:59pm then? Or do Judges grant whatever order they like even if the deadline is barely passed.Thanks

I am sorry to hear of this issue. When there is a deadline in federal court, you have until 11:59 p.m. that day to file. The deadline does not close at the close of business but at the end of the day unless the judge's order states otherwise. Generally, judges do not set time deadlines on orders but will set date deadlines so the document would be due by 11:59 p.m. I hope that helps. Ahh, ok. I got the vibe it was strategy on the part of the defendant's counsel (assistant US Attorney)... pushing me up to the deadline. Do you think its possible he would have himself "taken off work" after close of business day at 5pm, filed alone, and that would be a pretext for the Judge to grant his proposed order? Or am I way overthinking things.I'm thinking now he wanted me to go rogue.

I think that it would be more probable that the attorney was just busy and did not realize how close the deadline was until you filed and then said shoot! I need to file as well. I hope that makes sense.
