How do I stop a brother from coming to my hone to visit our mother when he is trying to gain control of her finances. My mother has lived with me for years and I am her caregiver.

JA: Thanks for all these details. What steps have you taken so far?
Customer: well nothing except I had to call the police two nights ago because he was behaving in a threatening manner , we both started arguing because he would not leave my home. He cannot be reasoned with. I downloaded a statutory power of attorney form that only requires my mom sig , mine and two witnesses . The form says I will be in charge of het finances and personal property. My brother says that he is going to take my Mom to have him gain control of her banking info. Etc

You need a power of attorney for healthcare and for finances for mom. If sounds like you have the forms. I would execute them. If he keeps this up, you could consider getting a restraining order on behalf of mom. I would keep contacting the police and execute the powers of attorney as soon as possible. Right away.

Okay what do you mean by execute?.. do you think the form that I have is adequate ??. it is a statutory power of attorney form. The form says it does not need to be notarized. Only signed by myself. Mother and two witnesses..My brother came over the first day of the stroke and got my Mother to sign a durable POA for healthcare.. but she was not lucid that day. But I'm unsure if I can do anything because it has already been signed.

I haven’t reviewed the forms and can’t say if they’re adequate. Execute means signed. It must be witnessed by 2 parties. Mom must sign it, not just you. I always prefer them to be notarized but that’s just my policy. A new power of attorney supersedes the old one. If new ones are executed those take precedent.
