A bad contractor left a project in shambles....

Resolved • Response time 1 minute

18 Jun 2021

A bad contractor left a project in shambles. It will cost 100K to make it right, after spending almost 400K. We may contact the CSLB, but they can only get 50K plus his license. How do I get the rest of the $ back?
JA: What state is the contractor in? It matters because laws vary by location.
Customer: CA
JA: What steps has the contractor taken so far?
Customer: He's been fired as of 3/13/2021
JA: Is there anything else the Lawyer should know before I connect you? Rest assured that they'll be able to help you.
Customer: I have a 5-page summary of the situation. If the lawyer could read it (for a fee) and make recommendations that would be very much appreciated.

He owes 4 years of life back. He was fired and the project will take 100K to get back up to code. He didn't follow the plans so the County won't approve the project. Plans are being redrawn by a new architect.

I'm so very sorry. You do have the right to sue him directly in civil court. Does he have an LLC?

I'm writing a report to the CSLB and they can take his license and arbitrate for up to 50K. A lawyer today said the lawsuit will take all the $.

A lawsuit can be expensive, although you do have the right to represent yourself. But you will have to use regular civil court since this is obviously well above small claims. With a judgment, you could get a lien on his house.

Oooh. Represent myself? Scary. But doable, I guess.

You also can get help with brief writing and legal research from a law student, much cheaper than an actual attorney.

How about a paralegal?

Yes, a paralegal can help with research and formatting as well. They just can't provide representation or legal advice.

Should a law student be specializing in contract law to assist me? Can I send the summary I've written up to a brand new lawyer for advice for just a small fee, like $50-100?

You can, I believe most charge $10 per page. Also, you could look for one focusing in contract law but for legal research, you could use any law student, although you'd want to lean towards 2 and 3Ls, since they have more experience.

Oh! Thanks for explaining that. I think I have enough for now. I appreciate your assistance. Does JustAnswer have referrals for a letter-reading attorney?

You can just post another question if you wish. Or if you do want a private attorney http://www.avvo.com is excellent.
